These Terms of Service (“Terms”) govern your access to and use of the ElevaFits website, products, features, content, tools, and related services (collectively, the “Services”).

Throughout these Terms, “ElevaFits,” “we,” “us,” and “our” refer to ElevaFits. “You” and “your” refer to anyone who visits our website, purchases a product, or otherwise uses the Services.

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, you should not use the Services.

1. Eligibility

You must be at least the age of majority in your jurisdiction to use the Services or make a purchase. If you permit a minor to use a product purchased through our store, you are responsible for providing appropriate adult supervision.

You may not use the Services or our products for unlawful, fraudulent, abusive, or unauthorized purposes.

2. Shopify

Our store is hosted and powered by Shopify. Shopify provides the ecommerce platform that enables us to offer our products and Services to you.

Purchases made through our store are transactions between you and ElevaFits. Shopify is not responsible for products purchased from us, including their quality, safety, delivery, or suitability.

3. Product Information

We make reasonable efforts to display product descriptions, dimensions, colors, images, specifications, availability, and prices accurately. However, colors and appearance may vary depending on your screen, lighting, manufacturing batches, or product updates.

We reserve the right to:

Correct errors, inaccuracies, or omissions
Update product information without prior notice
Limit the quantities available for purchase
Discontinue products at any time
Refuse or cancel orders where permitted by law

Product images may include props or accessories that are not included unless stated in the product description.

4. Fitness and Health Disclaimer

ElevaFits products are intended for general fitness and recreational use. Information available through the Services is provided for general informational purposes and is not medical advice, diagnosis, treatment, rehabilitation guidance, or a substitute for professional care.

Consult a qualified healthcare or fitness professional before beginning a new exercise program, particularly if you have an injury, medical condition, mobility limitation, are pregnant, or have concerns about your ability to exercise safely.

You are responsible for:

Reading all product instructions and warnings
Inspecting equipment before each use
Using products only for their intended purpose
Following recommended weight and resistance limits
Exercising in a safe and suitable environment
Using appropriate supervision when necessary

Stop exercising and seek appropriate assistance if you experience pain, dizziness, breathing difficulty, unusual discomfort, or other concerning symptoms.

To the fullest extent permitted by law, ElevaFits is not responsible for injuries or damage resulting from misuse, improper assembly, unauthorized modification, failure to follow instructions, unsuitable exercise techniques, or use contrary to product warnings.

5. Orders and Acceptance

Submitting an order does not guarantee acceptance. We may accept, reject, limit, or cancel an order for reasons including:

Product unavailability
Pricing or listing errors
Suspected fraud or unauthorized activity
Payment authorization failure
Shipping restrictions
Incorrect customer information
Quantity limitations

An order is accepted when we send confirmation that it has been processed or shipped. If we cancel a paid order, we will issue a refund to the original payment method.

6. Prices and Payments

Prices are displayed in the currency shown during checkout. Taxes, shipping fees, duties, and other applicable charges may be added before payment is completed.

You agree to provide current, complete, and accurate billing, shipping, and payment information. By submitting payment details, you represent that you are authorized to use the selected payment method.

Prices and promotions may change without notice. Price changes do not affect orders already accepted, except where a clear pricing error has occurred.

7. Shipping and Delivery

Shipping estimates are provided for convenience and are not guaranteed delivery dates. Delays may occur because of carriers, customs, weather, high order volume, incorrect addresses, or circumstances outside our reasonable control.

You are responsible for providing an accurate and complete delivery address. Additional costs caused by an incorrect address, refused delivery, or unclaimed package may be deducted from any available refund where permitted by law.

Risk of loss and ownership of purchased products transfer as provided by applicable law and the selected shipping arrangement.

8. Returns and Refunds

Returns, refunds, damaged items, and order cancellations are governed by our Return and Refund Policy.

Eligible return requests must generally be submitted within 30 days of delivery. Products that contact the body, including resistance bands, braces, supports, and apparel, may not be returnable after use for health and hygiene reasons unless they arrived damaged or defective.

Used or assembled fitness equipment may also be ineligible for return except where required by law or where the product arrived damaged or defective.

Nothing in our Return and Refund Policy limits any mandatory consumer rights available under applicable law.

9. Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your login details and for activity occurring through your account.

Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts involved in fraudulent, abusive, unlawful, or harmful activity.

10. Reviews and User Content

If you submit a review, photo, comment, testimonial, suggestion, or other content, you confirm that:

You own the content or have permission to submit it
The content is accurate and based on a genuine experience
It does not violate another person’s rights
It is not unlawful, defamatory, misleading, abusive, or harmful
It does not contain malware, spam, or unauthorized advertising

You grant ElevaFits a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, and distribute submitted content for operating, improving, and promoting the Services, subject to applicable law and our Privacy Policy.

We may remove user content that violates these Terms.

11. Prohibited Conduct

You may not:

Use the Services for unlawful or fraudulent purposes
Interfere with the security or operation of the website
Introduce viruses, malware, or harmful code

Attempt to access another customer’s account
Submit false information or impersonate another person

We do not control third-party platforms and are not responsible for their content, availability, security, practices, products, or services. Your use of third-party services may be subject to separate terms and privacy policies.

14. Privacy

Our collection and use of personal information are governed by our Privacy Policy. If these Terms conflict with the Privacy Policy regarding the collection, processing, or disclosure of personal information, the Privacy Policy will control.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided on an “as available” and “as is” basis, except for any express warranties provided with a product or rights that cannot legally be excluded.

We do not guarantee that the website will always be uninterrupted, error-free, secure, or available. We do not guarantee specific fitness, health, strength, weight-loss, rehabilitation, or performance results from using our products.

Some jurisdictions do not permit the exclusion of certain warranties, so parts of this section may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, ElevaFits and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Services or products.

Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

To the extent permitted by law, you agree to indemnify and hold ElevaFits harmless from claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, infringement of another person’s rights, or misuse of our products.

18. Termination

We may suspend or terminate your access to the Services if we reasonably believe you have violated these Terms, engaged in fraudulent or unlawful activity, or created a risk to ElevaFits, our customers, or third parties.

Obligations and provisions that should reasonably survive termination will remain effective.

19. Governing Law

These Terms are governed by the applicable laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict-of-law principles.

Any disputes will be handled by courts with appropriate jurisdiction, except where mandatory consumer protection laws give you the right to bring a claim elsewhere.

20. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

21. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

We may update these Terms to reflect changes to our Services, business practices, or legal obligations. Updated Terms will be posted on this website with a revised “Last updated” date.

Your continued use of the Services after updated Terms become effective constitutes acceptance to the extent permitted by law.

23. Entire Agreement

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies posted on the website, constitute the agreement between you and ElevaFits regarding the Services.
